These Terms of Use (the “Terms”) describe the terms and conditions on which Sports Holdings Limited, a company registered in England and Wales with company number 12367873 (“Sports Holdings,” “we,” “us,” or “our”) with registered office Home Farm, Coytrehen, Bridgend, Mid Glamorgan, Wales, CF32 8YS makes its Sports Offer services available to you (‘Sports Offers’).

These Terms apply to all Sports Offers services including all websites, mobile applications owned and operated by us or our affiliates that link to these Terms and all related online and offline services including any social media pages.

By using or accessing Sports Offers provided in connection with our business you are a Sports Offer User (‘the User’) and confirm your agreement to be bound by these Terms and our Privacy Policy If you do not agree to these Terms and the Privacy Policy, please do not use or access the Services. The Terms expressly supersede any prior terms of use between you and us or any of our affiliates or predecessors.

Unless we explain otherwise in this policy, the words and phrases used in this policy have the same meaning as in the Terms and Conditions of Use of Sports Holdings Limited.

Certain features, products or third party services that you use, purchase, or download through the Services may be subject to terms and conditions presented to you at the time that you use, purchase, or download them (in addition to these Terms, which will continue to be binding). Using, purchasing or downloading these features or products are subject to you accepting additional terms and conditions of use.

For the avoidance of doubt these terms are only applicable to Sports Offers e-commerce purchases. Purchases of other goods provided by Organisations are subject to the Organisation’s own terms and conditions.

Our Services

Sports Offers include the sale of sports and other goods sold by us through the Club Core Platform (‘the Platform’) to Users.

The following terms outline the terms associated with purchasing Sports Offer products.

Users over the age of 18 can purchase certain goods online using Sports Offers. By purchasing any such goods or subscriptions via the Platform you confirm you are over 18 years of age.

Please see our Delivery Information for details of delivery charges and restrictions. The delivery times given are estimated and from time to time may be affected by events outside our control, for example inclement weather or postal strikes, for which we will not be responsible.

In order to make a purchase you will need to set up an account. We will ask for personal information in order to set up the account and you agree to provide accurate, current, complete and non misleading information. Our Privacy Policy outlines how this information will be collected and managed.

By placing an order online you make an offer to purchase in accordance with these Terms and Conditions. We will acknowledge receipt of your order both online and via an email order confirmation but this does not constitute our acceptance of your offer to purchase. Your offer has been accepted only when we have confirmed that the order has been dispatched

Cancellation Terms:

If you are a User you have the right to cancel your contract with us and receive a full refund. You have 14 days from the day on which you receive your order to notify us that you wish to cancel, and you may do so by writing to us at info@sportsholdings.co.uk.

If you receive the items from your order on different days, this cancellation period shall end 14 days after the day on which you receive the final item of your order). You must then return your order in full without delay by post (at your own cost and risk). All goods contained in your order must be returned in their original condition (together with all packaging and labelling), and show no signs of use or damage. We reserve the right to refuse a refund if the goods do not meet this standard.

If your contract is cancelled in full, we will provide you with a refund for the item(s) within 14 days of our receipt.

We will not refund your delivery charge.

This right does not apply to perishable items, customised goods and items that are sealed for personal hygiene reasons where they have been unsealed.

Refund Terms

In addition to your Cancellation Terms, you can return your purchase to us within 21 days of dispatch of your order with your despatch note as proof of purchase for a refund.

All goods which you are returning must be unused, have all tags attached and be in their original condition (including packaging and labelling). If you use the goods or remove or tamper with any of the tags attached to the goods, you will lose your right to return the goods under our returns policy.

Unless faulty, we are unable to offer an exchange or refund on items that are sealed for personal hygiene reasons where they have been unsealed.

Delivery, return and transaction costs are not refundable.

The above policy does not affect your statutory rights including your rights in relation to faulty goods or your right to cancel orders made online. If you wish to exercise your cancellation rights please see the Cancellation section of Sports Offers Terms and Conditions.

Complete the returns form on your despatch note and include it with the item. If you no longer have the despatch note, put the following information on a piece of paper and include it with the item:

Name, Billing address and a contact telephone number

Email address (from your User account)

Order number (from your User account)

Description of the product

Reason for return

Returns sent by post are at your own cost. Make sure you obtain a free stamped Proof of Postage as we are not responsible for items that are lost in transit or damaged on their way back to us.

Your refund will normally be processed within 21 working days of receiving your return but it may take slightly longer to appear on your bank statement. We will refund the cost of the item, but not the postage costs or delivery charges or transaction costs unless the item was found to be faulty. This does not affect your legal or statutory rights and is subject to your right of cancellation as outlined in these terms and conditions.

Lead Time: 7 – 14 days after purchase date or as otherwise advised on the Services.

Payment

All prices are inclusive of relevant sales tax. Delivery costs are charged in addition to the product price and included in the total cost. Any additional charges are clearly displayed where applicable and included in the total cost.

General Terms

We always aim to ensure that all details, descriptions and prices appearing on this website are accurate, but from time to time errors may occur. While we try to accurately represent the colour of an item in our photography representation of the item may be affected by the settings of the computer on which it is viewed.

Where we have made an error in the price of an item on our site we reserve the right to withdraw this item from sale at this price and present it at the correct price. If you have placed an order at the incorrect price, we will inform you of the error and give you the opportunity to confirm your order at the correct price, or cancel the order.

All items sold are subject to availability and while every effort is made to fulfil your order, products turn over very quickly in our warehouse and on rare occasions the item you require may not be available although you have received a confirmation of your order. We will advise you by email if we have to cancel your order for this reason, and no payment will be taken.

Rewards

User may earn rewards for actions taken on Sports Offers and the Services.

These rewards may be used to claim discounts on certain purchases from Sports Offers.

Reward terms will be stated on Sports Offers and vary from time to time, including the maximum discounts that can be claimed on a purchase.

Rewards are applied to the value of the order, excluding delivery and transaction costs, and are subject to our general Terms and Conditions.

Unless stated, discounts cannot be combined and only one discount can be applied to any order.

Some items for sale will be excluded from reward offers.

Sports Offers retains the right to amend the terms of these rewards and discounts at any time.

Rewards and discounts can be amended or withdrawn at any time.

Disclaimer

You agree that use of the Sports Offers is at your own risk.

We make no promises that:

• Sports Offers will be available at any particular time,
• Sports Offers will meet any particular requirements or provide any particular results,
• The information on the Sports Offers will be accurate or up to date,
• The Sports Offers or the information transmitted to or from them or stored on them will be secure from unauthorised access,
• Information and content that you store in your Sports Offers account will remain retrievable and uncorrupted, or
• Sports Offers will be uninterrupted or error-free or will be free of viruses or other harmful components, or that defects will be corrected.

Although we try to ensure that the information posted on Sports Offers is accurate and up-to-date, we reserve the right to change or make corrections to any of the information at any time. We cannot, and do not, guarantee the correctness, timeliness, precision, thoroughness or completeness of any of the information available on Sports Offers. We do not provide advice and we cannot be expected to know what use you may make of the information posted on Sports Offers.

Liability

In no event will we be liable for any lost profits or any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from Sports Offers, your use of Sports Offers, even if we have been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from breach of contract, negligence or any other cause of action. If you are dissatisfied with Sports Offers or you do not agree with any part of these Terms, then your sole and exclusive remedy against us is to discontinue using Sports Offers. Nothing in these Terms shall exclude or restrict our liability for death or personal injury resulting from its negligence; nor for our fraud or fraudulent misrepresentation.

Other Terms

These Terms shall be governed by and construed in accordance with the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.

We reserve the right to assign or subcontract any or all of our rights and obligations under these Terms, to a third party.

These Terms contain the entire agreement between us and Sports Offers Users.

Our failure to act with respect to a breach of these Terms by Users or Organisations or others does not waive our right to act with respect to subsequent or similar breaches.

The headings to the Clauses are for ease of reference only and do not affect the interpretation or construction of these Terms.

The invalidity of one or more provisions of these Terms shall not affect the validity of the other provisions.
